This violated Article 111 of the Uniform Code of Military Justice. German Polizei apprehended Airman Powell near Landstuhl, Germany, March 6 during a traffic stop. The German authorities drew blood from Airman Powell, and it showed he had a blood alcohol content of .139, which exceeds the limit of .10 BAC under the UCMJ. At the court-martial, Captain Jeffrey Lorek, lead prosecutor for the Air Force, said even though Airman Powell had no prior disciplinary problems, his DUI could not go unpunished. Accordingly, during the sentencing portion of trial, Captain Lorek argued the appropriate punishment was a reduction in grade from E-3 to E-1, forfeiture of some basic pay, and restriction to the military installation.
